Every insurance soft market produces the same complaint: carriers are chasing volume at inadequate rates, MGAs are writing anything that moves, and brokers are placing business with little regard for the long-term sustainability of the pricing. The complaint is usually right. But it misidentifies the cause.
The problem is not that participants are making irrational decisions. They are making entirely rational decisions given the incentive structures they operate within. What is worth examining — and what this piece attempts to test — is whether those incentive structures have changed enough over the past decade that the misalignment between who earns and who ultimately pays has become a permanent feature of the market architecture, rather than a cyclical amplification of a problem that corrects when conditions harden.
The hypothesis is this: the modern insurance value chain has been incrementally reconstructed so that economic reward is concentrated near the point of risk origination, while balance sheet risk is pushed progressively further downstream — toward participants who have the least visibility into the quality of the underwriting decisions that produced it. The soft market intensifies the consequences of that architecture, but it did not create it.
The Current Market in One Sentence

The rate environment matters here primarily as context. This piece is not about whether rates are adequate — that is a line-of-business question. It is about the architecture of the chain that produces those rates, and whether the design of that chain means the consequences of inadequate pricing are distributed fairly between the parties who made the underwriting decisions and the parties who bear the risk.

Working Through the Chain
The insurance value chain, in its modern form, runs roughly as follows: a risk is identified by a retail broker, placed through a wholesale intermediary, underwritten by an MGA operating under delegated authority from a carrier or fronting entity, which has in turn transferred most of the underlying risk to reinsurers or alternative capital. At each step, an economic transaction takes place — commission, fees, profit sharing — typically realised immediately or within the policy year. The ultimate loss development, in long-tail casualty lines particularly, arrives years later, on balance sheets that are several links removed from the original underwriting decision.
The hypothesis, stated plainly, is that the further you sit from the point of origination in this chain, the more economic exposure you carry to the ultimate outcome — and the less visibility you have into the quality of the decisions that determine it. That is not how incentive alignment is supposed to work.
Brokers
Retail and wholesale brokers earn commission as a percentage of placed premium — typically 10–15% at retail — plus contingent income linked to volume, retention, and in some markets, loss performance. Their economic exposure to underwriting outcomes is minimal. A broker whose client's casualty book deteriorates severely enough to trigger a hard market cycle will write more commission in the subsequent hard market when premiums rise. Commission income is earned at placement and renewed annually regardless of claims development.
This is not a criticism of the broker model. It is a description of what that model produces under competitive pressure. A broker who declines to place business on grounds of pricing inadequacy loses the client to one who will. The market mechanism does not reward restraint, and the incentive structure does not require it.
Non-risk-retaining MGAs
MGAs sit at the most consequential point of the chain from an incentive standpoint. They make the underwriting decision — selecting risks, applying rating, setting terms — under delegated authority from a capacity provider. They earn commission of 15–25% of gross written premium, typically with a profit share element calculated on incurred losses at 12 or 18 months. And they do not hold statutory insurance reserves. That last point is important and is sometimes misunderstood.
When business an MGA has written deteriorates, the reserve impact lands on the capacity provider. The MGA has no balance sheet exposure to that development. Its exposure is entirely operational: if the deterioration is severe enough and sustained enough, the capacity provider reprices the relationship, restricts the authority, or withdraws altogether. That is a genuine and serious risk — an MGA whose authority has been revoked has lost its economic engine, and the consequences for the business can be severe. But it is a revenue and platform risk, not a reserve risk. Distinguishing between the two matters because it changes what PE investors are actually exposed to when they back these vehicles, and it changes what governance interventions are most likely to be effective.
The profit commission structure deserves specific attention. Profit commissions calculated on 12-month incurred loss positions in long-tail casualty lines are, by construction, measuring something other than ultimate underwriting profitability. A casualty book can appear entirely favourable in year one while carrying material reserve inadequacy in years five through ten, as incurred but not reported losses develop. The profit commission mechanism rewards the appearance of performance, not the substance of it. And once the commission is paid, it is not recoverable.

PE-backed MGAs: the capacity fragility problem
The private equity ownership of MGAs adds a dimension that was largely absent in the 2013–2017 cycle. The US MGA market reached $114 billion in direct premiums in 2024, having grown at 20.2% compound annually over the preceding five years, compared to 6.5% in the prior period. (Conning, 2025) PE investment has been a significant driver of that growth, attracted by the combination of high-margin fee income, predictable renewal revenue, and balance-sheet-light capital requirements. Deals have been closing at double-digit EBITDA multiples in a competitive acquisition market. (Deloitte, 2025)
The incentive misalignment in a PE-backed non-risk-retaining MGA is not primarily about reserve cliffs. It is about what happens when the underwriting quality of the book starts to deteriorate. Capacity providers do not immediately withdraw. They first notice adverse development in bordereaux data — typically lagged by 12–18 months from the underwriting decisions that caused it. They then engage in discussions with the MGA, renegotiate terms, potentially slide commissions, and begin to consider whether to continue the relationship. This process takes time. During that time, the MGA is still writing business, still earning commission, and the PE investor's equity value still reflects the GWP growth story rather than the developing underwriting problem.
The risk for a PE investor approaching an exit from a casualty-heavy MGA is therefore not a reserve cliff they will inherit — it is that capacity fragility becomes visible during a transaction process, repricing the asset downward at a critical moment. The actual reserve deterioration belongs to the capacity providers. The PE loss is in the multiple compression that follows when the GWP growth story unravels. Those are meaningfully different problems, but neither is benign, and both are real.
Fronting carriers
Approximately 25 major fronting carriers now operate in the US. Gallagher Re reported that hybrid fronting carriers were generating nearly $28 billion in gross written premiums by early 2025, with fronting carriers supporting an estimated $18–19 billion in MGA premium — a 26% increase year-over-year. (Conning, 2025; Gallagher Re, 2025)
The fronting model creates a specific problem for the chain's information architecture. A fronting carrier providing rated paper to an MGA retains typically 5–30% of the risk, earning a fee for the service and passing the remainder to reinsurers or ILS capital. Its economic incentive is volume — more programmes, more fee income. Its visibility into the underwriting quality of those programmes depends on bordereaux reporting that reflects incurred rather than ultimate positions. When a reinsurer receives treaty cessions from a fronting carrier writing on behalf of an MGA, it has at minimum three intermediary layers between itself and the original risk selection decision. Its information about that decision arrives slowly, in aggregated form, without the granularity that would allow it to distinguish between a well-run programme and a deteriorating one until the loss development becomes obvious.
This is not a design failure on anyone's part. It is the natural consequence of assembling a chain where each link is economically rational but the cumulative effect is to remove the ultimate risk bearer further and further from the information it would need to police underwriting quality in real time.

Reinsurers: the last line of discipline
Reinsurers sit at the far end of the chain, bearing the most tail risk with the least origination visibility. They are also, in the current cycle, the most disciplined participants. At the April 2026 reinsurance renewals, Gallagher Re observed that casualty pricing remained "broadly stable," with reinsurers maintaining what it described as a "disciplined approach" focused on loss trends and prior-year development. This was against a backdrop of property catastrophe rates falling 14% year-to-date — meaning the discipline in casualty was conscious and deliberate, not a passive residue of the prior hard market.
Reinsurers are in the chain's most paradoxical position. They are furthest from the underwriting decision, yet they are the entity with the most direct financial incentive to price long-tail risk accurately. Their governance mechanisms — attachment point discipline, ceding commission structures, treaty terms — are the most powerful levers available to anyone in the chain for influencing underwriting quality. Tightening ceding commissions is a reinsurer's clearest signal of concern about book quality, visible before loss ratios shift materially. That capacity and willingness to exercise discipline is the market's primary correction mechanism.
The question that matters going forward is whether the record $136 billion of alternative and ILS capital in the market — including a growing and untested casualty ILS sector of approximately $1.7 billion that Willis Re described in January 2026 as still "untested" through full claim maturation — will erode that discipline by providing cheaper capacity without equivalent governance requirements. Capital that built its track record in property catastrophe risk, where loss development is fast and transparent, does not have the same institutional memory for casualty loss development dynamics. If that capital enters casualty at scale and undercuts reinsurer discipline, the principal correction mechanism in the chain weakens at precisely the moment it is most needed.
Where the Hypothesis Holds and Where It Does Not
The hypothesis holds most clearly for retail and wholesale brokers, and for non-risk-retaining MGAs. In both cases, the economics of the business are genuinely and by design separated from underwriting outcomes. This is not new. What has changed is the proportion of the market now operating under these arrangements. When non-exclusive MGA arrangements accounted for 33% of US P/C direct premiums in 2017 and 57% by 2024, the aggregate incentive misalignment at the sector level became a different kind of problem. The hypothesis is more complicated for risk-retaining MGAs, and this qualification is important. An MGA that participates in underwriting risk through an affiliated captive, quota share participation, or similar skin-in-the-game structure has aligned economics with its capacity providers. These entities exist and are growing in number precisely because some capacity providers have recognised the governance value of aligned incentives. They are more likely to maintain long-term capacity relationships and to enforce pricing discipline under competitive pressure, because the financial consequences of failure are theirs to absorb as well as the capacity provider's. The hypothesis does not apply to them, and treating all MGA growth as equivalent misses this distinction.
The hypothesis is also partially undermined by the reinsurance sector's current posture, as noted above. Discipline in casualty reinsurance — if it holds — means the market does have a functioning correction mechanism. The question is durability, not existence.
The strongest version of the hypothesis applies to non-risk-retaining structures under PE ownership, writing significant volumes of casualty business with concentrated capacity relationships, approaching exit windows, with limited real-time visibility into developing loss positions. Those conditions are not universal, but they describe a meaningful and growing subset of the market. And they describe a subset operating in a casualty environment where social inflation ran at 7% in 2023 (Swiss Re, 20-year high), nuclear verdicts in 2024 reached $31.3 billion in aggregate awards, and third-party litigation funding is now approaching $19 billion globally — all conditions that extend the latency of loss emergence and amplify the severity of development when it arrives.
Casualty rates have been rising, not falling. US casualty increased 9% in Q1 2026, reflecting the market's recognition that loss costs are growing faster than general inflation. The argument here is not that casualty is being mispriced in a classic soft market sense. It is that casualty is being underwritten through an incentive architecture that makes it difficult to detect deterioration in time to prevent it accumulating across multiple accident years — regardless of whether headline rates are rising or falling.
The Architecture Is the Problem, Not the Cycle
The incentive misalignment in the insurance value chain is not a soft market phenomenon. It is a feature of how the chain has been assembled — commission at inception, reserves downstream, governance lagging between the two. What a soft market does is intensify its consequences: competitive pressure increases the incentive to prioritise volume over discipline at the point of origination, while the delayed nature of loss development means the consequences arrive long after the decisions that produced them.
The market will correct. The correction mechanism — primarily reinsurer discipline on attachment points and casualty treaty terms — exists and is currently functioning. But it operates more slowly and more indirectly than in previous cycles, because governance signals arrive later, after more business has been written, and in a form that is harder to attribute to specific origination decisions. The fronting model adds additional lag. The growth of non-risk-retaining MGA volumes adds scale to the misalignment. And the entry of untested alternative capital into casualty creates the possibility that the principal correction mechanism itself comes under pressure before the current cycle's underwriting quality has been properly tested.
None of this is grounds for alarm about the insurance market as a whole. Most of what is happening in property, D&O, and cyber is recognisably cyclical and will self-correct as conditions shift. The specific risk worth watching is narrower: the segment of the market where underwriting authority is most concentrated in non-risk-retaining structures, capacity relationships are most concentrated, and exit incentives are most misaligned with the timeline of loss development. That segment has grown materially over the past five years. Whether it has grown past the point where reinsurer discipline alone can keep it honest is the question the next cycle will answer.
